Milwaukee Brewers outfielder Ryan Braun, the reigning National League MVP, won his appeal of a positive test for a performance-enhancing drug and will avert a 50-game suspension.

Major League Baseball and the players' union announced the decision Thursday, a day before Braun is expected to arrive at the Brewers' spring training camp in the Phoenix suburb of Maryvale.

NEW YORK (AP) National League MVP Ryan Braun's 50-game suspension has been overturned by baseball arbitrator Shyam Das.

The decision was announced Thursday by the Major League Baseball Players Association.

An outfielder for Milwaukee, Braun tested positive in October for elevated testosterone, and ESPN revealed the positive test in December.

No reasoning was given for Thursday's decision.

"Today the arbitration panel announced its decision, by a 2-1 vote, to sustain Ryan Braun's grievance challenging his 50-game suspension by the commissioner's office," a statement from the players' association said.

It's bullshit because it was overturned due to a technicality in the testing process and had nothing to do with the actual result of the test.

The MLB is beyond pissed that it was overturned as well.

Ryan Braun, the reigning National League MVP, had his 50-game drug suspension overturned on Thursday in a somewhat shocking development.

No player had ever won an appeal of such a suspension in the past.

Braun's lawyers never argued about the Milwaukee outfielder taking any sort of performance-enhancing drug, instead they focused on the handling of his urine sample and won.

"This," one baseball official said, "is like a criminal getting off because he wasn't read his Miranda rights."

The belief is that Braun was exonerated because of a loophole.

"It's a kick in the gut to clean athletes," said Travis Tygart, the CEO of the United States Anti-Doping Association.

Weren't his results like 3 times higher than any test result in the history of testing?

I'd say those are pretty bogus results and his suspension should be overturned, but I haven't really paid much attention to this, so I don't know...

Not sure if thats the highest positive test in MLB, but overall Labs have seen higher results.

The folks at MLB would answer that’s because he almost certainly is a cheater. That protocol was followed, that the sample arrived intact in Montreal, and that the head of the laboratory there testified in Braun’s hearing there was nothing unusual found in the sample or the T/E (testosterone to epitestosterone) ratio, beyond the fact it showed positive.

(A 4:1 ratio triggers a positive test. Braun’s was about 30:1. While that is very high, the lab has seen ratios of 80:1 and higher.)

If it looks like a rat, smells like a rat and acts like a rat then it usually is a rat.

I love the way their defense was 100% focused on the process. It doesn't seem right - something's definitely amiss here.

Even so, lawyers will represent the scumiest people on the planet and blatantly lie for them so I wouldn't place much faith in their ethics.
