I don't think the death penalty would really apply to this case. He didn't wake up wanting to kill his friend. This guy was on shrooms which caused him to murder his friend. There is a good chance they will lower the first degree murder to maybe third. A few years Cali introduced a law that stated if someone murdered someone while under the influence (alcohol, drugs) they would be charged with third degree.
